Lab Bite Child

My brother has a 4 year old Chocolate lab that he has spent a lot of time. The dog is well trained. However, he seems to be aggressive with children. Last night the dog bite my brothers two year old daughter while she was playing with him. This is the second time that this has happened. The bite on her head required stitches. Is there any recourse for my brother but to get rid of this dog?:
